Terms of Service
Effective 21 September 2026. These terms are an agreement between Property Stack Pty Ltd (ABN 43 612 526 888) (“PharmacyPulse”, “we”, “us”) and the organisation that subscribes to PharmacyPulse HR (the “Service”) for one or more pharmacies (“you”). By requesting an invitation, entering payment details or using the Service, you agree to them. The person who accepts them warrants that they are authorised to bind the organisation.
1. The Service
The Service is a record-keeping and compliance-management system for Australian community pharmacies: staff files, onboarding, policies, registers, daily checks, notifications and an assessor pack, organised against the Quality and Safety Pharmacy Program (QSPP). It is provided as an online service; we host it, keep it running and improve it over time.
PharmacyPulse is not affiliated with or endorsed by the Pharmacy Guild of Australia or the QSPP. The Service assists with record-keeping and assessment preparation. It does not guarantee accreditation, does not constitute professional, legal or compliance advice, and does not replace the pharmacy's own judgement or its obligations under any law, standard or program.
2. Accounts and access
- The person who requests the invitation becomes the pharmacy's first director on the Service and may add other people and set their roles.
- Each person must use their own login. Every personal login is protected by a password and an authenticator code; you are responsible for keeping them confidential and for everything done under the logins you issue.
- The shared store login is for the pharmacy's own terminal and holds no personal records. You are responsible for who can reach that terminal.
- You must tell us promptly if you believe a login has been compromised.
3. Fees and billing
- The fee is A$99 per pharmacy per month, in Australian dollars, GST is not currently charged; if Property Stack Pty Ltd registers for GST the fee will be stated inclusive of GST and the tax invoice will show it.
- Payment details are entered before a pharmacy is created. The first month is charged at that point and each further month is charged automatically on the same day of the month.
- Each pharmacy is subscribed and invoiced on its own. An organisation with several pharmacies holds one subscription per pharmacy, each in that pharmacy's name, and may cancel any one of them without affecting the others.
- If a payment fails, the card is retried and we notify the pharmacy's directors. If every retry fails, access to that pharmacy is suspended (read-only) until a payment succeeds. Nothing recorded is lost by suspension.
- There is no free trial, no set-up fee, no contract and no minimum term.
- We may change the fee on sixty days' written notice to the billing contact; the new fee applies from the next monthly charge after the notice period.
4. Cancellation
You may cancel at any time from Administration › Billing. Cancellation takes effect at the end of the month already paid for; access continues until then and no further charge is made. Fees already paid are not refunded for a partial month, except where the law requires it. On request to support@pharmacypulse.com.au, before the subscription ends or within the retention period after it, we provide a complete copy of the pharmacy's records in a readable form; after the retention period of 12 months we delete them, as described in the Privacy Policy. The pharmacy remains responsible for keeping its own employee records for the period the Fair Work Regulations 2009 require (seven years).
5. Your records and your responsibilities
- The records you enter remain yours. You grant us the licence needed to host, process, back up and display them in providing the Service.
- You are responsible for the accuracy and completeness of what is recorded, for having the right to record it (including any consent the law requires for staff health information), and for reviewing and adopting the policies and templates the Service issues before relying on them.
- You must not use the Service to store information you are not entitled to hold, to interfere with its operation, to attempt to reach another organisation's records, or for any unlawful purpose.
- You are responsible for your own compliance with the Privacy Act 1988 and any other law that applies to the records you keep.
6. Our responsibilities
- We will provide the Service with reasonable care and skill, keep it available except for maintenance and matters outside our control, and hold your records securely as described in the Privacy Policy.
- We will not access your records except to provide the Service, to support you at your request, to investigate a fault or misuse, or as the law requires.
- We will give reasonable notice of any change that materially reduces what the Service does.
7. Suspension and termination
We may suspend access for non-payment as set out above, or immediately where the Service is being used in breach of these terms or in a way that threatens its security or other customers. We may end this agreement on sixty days' written notice, in which case fees for any unused period are refunded. Either party may end it immediately if the other is in material breach and does not remedy it within fourteen days of written notice.
8. Liability
The Australian Consumer Law gives guarantees that cannot be excluded. Nothing in these terms excludes, restricts or modifies them. To the extent the law permits, our liability for any claim arising out of the Service is limited to resupplying the Service or, at our election, refunding the fees you paid in the twelve months before the claim, and we are not liable for loss of profit, loss of business, or any indirect or consequential loss. We are not liable for the outcome of any assessment, audit or regulatory action, which depends on the pharmacy's own practice and records.
9. Changes to these terms
We may update these terms. Material changes are notified to the billing contact by email at least thirty days before they take effect; continuing to use the Service after that date is acceptance. The current version is always at pharmacypulse.com.au/terms.
10. General
These terms are governed by the laws of South Australia, and the courts of South Australia have jurisdiction. If any part is unenforceable, the rest remains in effect. Notices to us are to be sent to support@pharmacypulse.com.au; notices to you are sent to the organisation's billing contact.
